for the purchase of digital content (PX‑eBooks)

1. Scope

These Terms and Conditions apply to all paid downloads of digital content (PX‑eBooks) offered via https://www.philodex.com/shop.The offer is available to adults worldwide. Contract languages are German and English.

 

2. Conclusion of Contract

  1. The presentation of products in the shop constitutes a binding offer to conclude a contract for the download of digital content.
  2. By clicking “Buy now”, you accept this offer and the contract is concluded.
  3. Before completing the purchase, you must expressly agree that
  • the execution of the contract begins immediately, and
  • you thereby lose your right of withdrawal.

This is required by EU law for digital content not supplied on a physical medium.

 

3. Prices

All prices include applicable VAT.
No shipping costs apply.

 

4. Payment

  1. Accepted payment methods are credit cards and PayPal.
  2. Statutory interest applies in case of late payment.
  3. A reminder fee of EUR 7.50 may be charged.

 

5. Delivery and Download

  1. Delivery is made by providing a download link via email.
  2. The link is sent immediately after the order is completed.
  3. The link may be used three times and is valid for seven days as of the date of purchase. A replacement link is not guaranteed.
  4. You are responsible for securing the file after download and for providing suitable software to open it.

 

6. Usage Rights

  1. All PX‑eBooks are protected by copyright.
  2. You receive a simple, non‑transferable, perpetual licence for private use only.
  3. Usage rights are granted only after full payment.
  4. Digital files may contain visible or invisible personalisation.
  5. In cases of intentional unauthorised distribution, the provider reserves the right to claim damages.
  • The following are not permitted:
  • sharing with third parties
  • public distribution
  • commercial use
  • reproduction beyond personal use

 

7. Exclusion of Withdrawal

Your right of withdrawal expires once the download begins, after you have expressly agreed to the immediate execution of the contract and acknowledged the loss of that right.

 

8. Warranty and Liability

  1. Statutory warranty provisions apply.
  2. Liability is limited to intent and gross negligence where legally permitted.
  3. Liability for personal injury remains unaffected.
  4. The provider is not liable for technical issues outside their control.

 

9. Data Protection

The privacy policy available on the website applies.

 

10. International Customers

  1. The provider sells digital content worldwide.
  2. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  3. Consumers additionally benefit from the mandatory consumer protection laws of their country of residence.
  4. No court jurisdiction is agreed upon for consumers.

 

11. Final Provisions

  1. If any provision of these Terms is invalid, the remaining provisions remain unaffected.
  2. Changes to the Terms will be published on the website.
